These terms and conditions apply to your membership of the www.truvo.be website and the affiliated websites located at www.truvo.be (collectively, the "Site"). By registering to the Site or by any way of using, accessing, browsing, crawling or scraping the Site, you expressly agree to these terms and conditions, to our privacy policy (the "Privacy Policy") and to all other guidelines or policies referred to herein (collectively, the "Terms & Conditions").
You understand and agree that the Site may still contain bugs, suffer disruptions and not operate as intended or designated. Your use of the Site at this stage confirms your understanding of and consent to participate in the site's Beta testing.
Content of these Terms & Conditions:
"User": any person who accesses, browses, crawls or scrapes or in any other manner uses the Site.
"Truvo": Truvo Belgium Comm. V., located at Keyserlei 5 bus 7, 2018 Antwerpen, Belgium.
"Content": reviews, texts, images, photos, audio files, video files, links and all other forms of information or communication made available on the Site.
"Your Content": Content that you submit to or post on the Site or transmit to others by using the Site, such as, but not limited to, business ratings, reviews, tags, compliments, information that you display as part of your account profile, invitations, or other commentary that you may submit, post, or transmit to others using the Site. Your Content does not include the information that you submit in order to create an account on the Site.
"User Content": Content that you or any other User submits, posts or transmits to the Site.
"Third Party Content": Content that is made available on the Site by parties other than Truvo or the Users, such as data providers who license data to Truvo for use on the Site.
Truvo will only collect, save and use your personal data in order to provide access to and manage the functionality of the Site.
Truvo's Privacy Policy forms an integral part of these Terms & Conditions.
In order to be able to use certain functionalities of the Site, you will have to register with the Site by creating an account and providing Truvo with information about yourself under the following conditions:
You may freely select your user name (or accept the user name suggested by the Site's registration system). The chosen user name may not run counter to current Belgian law, the rights of third parties, these Terms & Conditions or any moral and ethical standards.
When defining your user name and/or image, you may not:
You undertake to make use of the Site in a lawful manner, and that you will not contravene these Terms & Conditions, the applicable laws or the rights of third parties.
You are responsible for all the Content that is published or posted on the Site under your user name. For this reason you select a password for your user name and take the necessary measures to ensure that it is kept secret. Any unauthorised use of your account should immediately be notified to Truvo.
As a User, you have a wide range of different possibilities to use the Site. The following is however strictly prohibited:
As a User you are authorised to write reviews. Truvo, however, reserves the right to decide whether and to what extent a review is published on the basis of its own evaluation and may remove any review at all times and for any reason without prior notice to the User concerned. This decision cannot be contested by the User.
The following rules apply to the reviews:
Truvo reserves the right to rate reviews posted by the Users. For example, Truvo is authorised to give reviews by Users who post several reviews a higher rating than reviews by Users who post fewer reviews. The same applies to reviews by Users that are given positive ratings by other Users.
With regard to Your Content such as reviews, pictures, etc., you hereby grant Truvo the free, non-exclusive and unlimited right to use Your Content along with the user name that you have chosen.
While maintaining the author's moral rights as well as your personal rights, Truvo is authorised to duplicate, provide public access to and to make Your Content available on request (online-, access-, and transmission rights) and to store or archive it in databases.
You confirm that you have all necessary rights to use the User Content which you have made available and that you are authorised to transfer these rights to Truvo.
You agree that Users may search for other Users based on criteria including sex, age, and other public profile information that you have supplied to Truvo in connection with your registration. Your profile may be included in the search results, unless you disallow this in your account's privacy options.
Truvo reserves the right to decide whether and to what extent User Content is published on the basis of its own evaluation and may remove any Content at all times and for any reason without prior notice to the User concerned.
Truvo is only authorised to modify Your Content in as far as such is necessary for the purposes of graphic representation or for editorial reasons.
If third parties should take legal action against Truvo due to either the Content published or posted by you and/or the uploading, and/or the use of photos, you are obliged to compensate Truvo for all damages which Truvo may be obliged to pay as a result of such legal action by a third party.
In case of (a suspicion of an) infringement of criminal or public law, Truvo will assist the public authorities in their investigations without having to examine the legitimacy of such investigations and/or requests for information.
Truvo does not have an obligation to monitor compliance with these Terms & Conditions. However, Users may report infringements of these Terms & Conditions to: team@truvo.com. Any complaints by Users will be treated confidentially.
Truvo may provide incentives to certain actions of Users (such as writing reviews or uploading pictures) with so-called "Truvo Points". The rules concerning the awarding of the Truvo Points are specified by Truvo only and can be changed by Truvo at any time without notice. No legal claim exists regarding such Truvo Points. Truvo Points acquired through improper actions will be deleted by Truvo.
You are allowed to cancel your membership at any time without prior notice.
Truvo reserves the right to terminate your membership with immediate effect in case of a violation of these Terms & Conditions. If Truvo terminates your membership without notice due to a contravention of these Terms & Conditions, you are prohibited from registering for the Site again without Truvo's prior explicit consent.
In addition to the above, Truvo reserves the right to block or terminate your account if it deems that such is necessary or useful for the management of the Site.
After termination of your account, Truvo reserves the right to keep online any Content which you have previously posted to the Site, such as reviews, comments, etc. This Content will be shown without the username and displayed as Content by a deleted User.
Your right to cancel your membership for personal reasons is not affected by these Terms & Conditions.
With respect to damages suffered by Users in connection with the Site, Truvo, including its employees, representatives and auxiliary persons, is only responsible in as far as the damages are caused by its gross negligence or willful misconduct.
The fact that Truvo offers a platform for the Content does not mean that Truvo owns this Content, nor does it mean that Truvo supports or accepts the Content or engages itself as an editor of the Content.
The responsibility for third party Content lies exclusively with the service provider and/or the person who has posted such Content on the Site.
Truvo reserves the right to change these Terms & Conditions at any time.
Prior to a change to these conditions of use, Truvo will inform you about the changes: either the changed Terms & Conditions will be made accessible to you prior to their activation on the homepage of the Site and your approval will be requested, or Truvo will inform you about these changes by sending an e-mail to the e-mail address provided at the moment of registration at least one month before the changes enter into effect. Unless you expressly object to the modified Terms & Conditions by informing Truvo by e-mail within one month of the notification of the proposed modifications, in which case your membership will be terminated, the new Terms & Conditions will enter into effect automatically one month after the notification thereof.
The application of these Terms & Conditions and the use of the Site are governed by Belgian law. The Courts of Antwerp (Belgium) are exclusively competent to hear any dispute that may arise in the context of the use of the Site or the application of these Terms & Conditions.
